Ha de contribuir tots els propietaris (incloent-hi els dels locals i garatge)."},"content":{"rendered":"\n<p>El Tribunal Supremo en su reciente sentencia de 6 de febrero de 2024, n\u00ba: 152\/2024 reitera su doctrina acerca de la obligaci\u00f3n que tienen todos los propietarios de pisos y tambi\u00e9n los de los locales de planta baja y de los garajes, de contribuir a la colocaci\u00f3n del ascensor acordada por la Comunidad de propietarios. Rechaza el argumento de los propietarios de los locales y plazas de garaje en el sentido de que no realizan un uso ordinario del ascensor y que, conforme a los estatutos, est\u00e1n excluidos de los gastos de ascensor, pese a lo cual se les impone la obligaci\u00f3n de pago por coeficiente, distintos de los previstos en la escritura de divisi\u00f3n horizontal. En esa sentencia, el Tribunal Supremo dice:<\/p>\n\n\n\n<p><strong>\u201c<\/strong>Es jurisprudencia consolidada de esta sala que cuando se instala un ascensor <em>ex novo<\/em>, los propietarios de los locales comerciales y de los garajes tambi\u00e9n deben contribuir al gasto que ello supone, y su exclusi\u00f3n por la falta de uso resultar\u00eda abusiva con respecto a los propietarios de las viviendas \u2026 lo que requerir\u00eda haber sido aprobado [la exenci\u00f3n al pago de los locales y garaje] por unanimidad\u201d ya que, a\u00f1ade \u201c<em>la instalaci\u00f3n de un ascensor antes inexistente no es una simple mejora\u201d.<\/em><\/p>\n\n\n\n<p>La Sentencia recuerda una anterior del mismo Tribunal: &nbsp;la 276\/2021 que sintetiza la jurisprudencia en la materia, en los siguientes t\u00e9rminos:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>la instalaci\u00f3n de un nuevo servicio de ascensor debe ser sufragado asimismo por los due\u00f1os de los locales, ya que solo estaban exentos de su conservaci\u00f3n o mantenimiento (art. 10 de la Ley de Propiedad Horizontal)<\/em><\/li>\n\n\n\n<li><em>la instalaci\u00f3n del ascensor, y aqu\u00ed la ampliaci\u00f3n de su trayectoria (\u00aba cota cero\u00bb), ha de reputarse no solo exigible, sino tambi\u00e9n necesaria y requerida para la habitabilidad y uso total del inmueble, impuesta por la normalizaci\u00f3n de su disfrute por todos los vecinos, y no como una simple obra innovadora de mejora.<\/em><\/li>\n\n\n\n<li><em>una previsi\u00f3n estatutaria que establece la exenci\u00f3n de participaci\u00f3n de los due\u00f1os de los locales en los gastos de entretenimiento, conservaci\u00f3n y reparaci\u00f3n ordinaria del portal y del ascensor, no ampara que no deban contribuir a los gastos de instalaci\u00f3n, al no estar expresamente previsto e ir m\u00e1s all\u00e1 de lo dispuesto en los arts. 9, 10 y 5 de la Ley de Propiedad
