{"id":1831,"date":"2025-01-30T14:04:31","date_gmt":"2025-01-30T13:04:31","guid":{"rendered":"https:\/\/afirmajuridico.com\/?p=1831"},"modified":"2025-01-30T14:05:10","modified_gmt":"2025-01-30T13:05:10","slug":"nuevo-decreto-ley-1-2025-contencion-rentas-alquiler-contrato-alquiler-vivienda","status":"publish","type":"post","link":"https:\/\/afirmajuridico.com\/cat\/nuevo-decreto-ley-1-2025-contencion-rentas-alquiler-contrato-alquiler-vivienda\/","title":{"rendered":"El nou decret llei 1\/2025: noves mesures per a la contenci\u00f3 de rendes de lloguer a Catalunya."},"content":{"rendered":"<p><\/p>\n\n\n\n<p>El <strong>Diari Oficial de la Generalitat de Catalunya va publicar ahir, 29.01.2025 <\/strong>el <strong><a href=\"https:\/\/portaldogc.gencat.cat\/utilsEADOP\/PDF\/9339\/2068659.pdf\">decret llei 1\/2025, de 28 de gener<\/a><\/strong>, de mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes. La principal mesura que cont\u00e9 \u00e9s , la principal del qual del r\u00e8gim sancionador per garantir el compliment de la contenci\u00f3 de rendes del lloguer es troba en el <strong>Decret 10\/2009, del 27 de gener.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quines s\u00f3n aquestes noves mesures que afecten els contractes de lloguer a zones declarades de mercat tensat?<\/h2>\n\n\n\n<p>Segons l&#039;Exposici\u00f3 de motius del Decret llei les mesures que incorpora \u201c<em>(IV) \u2026 estan orientades a assolir els objectius de protecci\u00f3 dels arrendataris amb necessitat d&#039;habitatge permanent a les zones declarades de mercat tensat,..\u201d<\/em><\/p>\n\n\n\n<p><em>\u201cEn aquesta mateixa l\u00ednia, tamb\u00e9 \u00e9s necessari, i aix\u00ed ho fa aquesta disposici\u00f3 normativa, preveure certes obligacions d&#039;informaci\u00f3 als anuncis, les ofertes d&#039;arrendament i els mateixos contractes, com \u00e9s el preu que resulta d&#039;aplicar el sistema d&#039;\u00edndex de refer\u00e8ncia , el preu de la darrera renda del contracte d&#039;arrendament o la condici\u00f3 de gran forquilla de la persona propiet\u00e0ria de l&#039;habitatge quan els immobles estiguin ubicats a zones de mercat residencial tensat\u2026\u201d<\/em><\/p>\n\n\n\n<p><strong>El Decret llei modifica diversos articles de la Llei 18\/2007, del dret a l&#039;habitatge, de Catalunya<\/strong>, per ampliar els deures d&#039;informaci\u00f3 a les ofertes d&#039;habitatges de lloguer i al contracte de lloguer sobre el preu del lloguer dels darrers cinc anys, el preu que resulta d&#039;aplicar el preu de refer\u00e8ncia de lloguer i la condici\u00f3 de gran forquilla del lloguer arrendador. A m\u00e9s, s&#039;afegeix com a infracci\u00f3 formalitzar contracte de lloguer de temporada en frau de llei; s&#039;estableix un termini per adaptar els anuncis i les ofertes de cinc dies que finalitza el 4 de febrer de 2025.<\/p>\n\n\n\n<p><strong>Aquestes noves mesures <\/strong>van acompanyades d&#039;un r\u00e8gim sancionador que <strong>pot portar a imposar sancions fins a 900.000 euros.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><\/ul>\n\n\n\n<p>Amb aquestes mesures urgents, el reial decret busca equilibrar els drets i les responsabilitats tant d&#039;arrendadors com d&#039;inquilins, promovent una major transpar\u00e8ncia i protecci\u00f3 al mercat de lloguers de les zones declarades de mercat tensat.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Com podeu con\u00e8ixer l&#039;\u00edndex de preus de refer\u00e8ncia de la vostra renda de lloguer?<\/h3>\n\n\n\n<p>Per obtenir el preu de refer\u00e8ncia de lloguer: el <a href=\"https:\/\/serpavi.mivau.gob.es\/\"><strong>Sistema Estatal de Refer\u00e8ncia de Preus de Lloguer d\u00b4Habitatge (SERPAVI)<\/strong><\/a> del Ministeri dHabitatge i Agenda Urbana.
