Sent\u00e8ncia del Tribunal Suprem."},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"1908\" class=\"elementor elementor-1908\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2a7e543c e-flex e-con-boxed e-con e-parent\" data-id=\"2a7e543c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-192fa94 elementor-widget elementor-widget-text-editor\" data-id=\"192fa94\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\n<p>Es planteja la possibilitat que una comunitat de propietaris que va acordar que determinats habitatges no participessin en les despeses d'instal\u00b7laci\u00f3 i manteniment de l'ascensor (o d'altres millores i instal\u00b7lacions), despr\u00e9s pretengui fer obligat\u00f2ria la participaci\u00f3 d'aquests habitatges i locals en aquestes despeses.<\/p>\n\n<p>1. Quan l&#039;acord previ sobre el repartiment de despeses o exoneracions est\u00e0 incorporat als estatuts de la comunitat, la Llei de propietat horitzontal exigeix que la seva modificaci\u00f3 s&#039;acordi per unanimitat de tots els propietaris ja que el t\u00edtol constitutiu i els estatuts constitueixen la base contractual i normativa de la comunitat, i qualsevol alteraci\u00f3 de les seves normes fonamentals.<\/p>\n\n<p>2. Si l&#039;acord previ sobre el repartiment de despeses o exoneracions no est\u00e0 incorporat al t\u00edtol constitutiu ni als estatuts, i es va establir que determinats propietaris que no facin \u00fas del servei (ascensor, millores\u2026) no han de contribuir a les despeses que es derivin d&#039;aquest servei, despr\u00e9s, per modificar o deixar sense efecte aquest acord \u00e9s necessari el vot favorable.<\/p>\n\n<p>I aix\u00f2 \u00e9s aix\u00ed encara que el nou acord pretengui emparar-se en una llei posterior que flexibilitza les majories.<\/p>\n\n<p>Aquest \u00e9s el cas que ha jutjat el Tribunal Suprem a la seva sent\u00e8ncia de 25\/06\/2025, n\u00fam. 1002\/2025 que pots consultar <a href=\"https:\/\/www.poderjudicial.es\/search\/AN\/openDocument\/4b41a77a3d63933da0a8778d75e36f0d\/20250703\">aqu\u00ed<\/a> , que va establir:<\/p>\n\n<p><em>\u201cPer\u00f2 una cosa, \u00e9s declarar determinades obres com a obligat\u00f2ries, o reduir les majories per adoptar acords, i una altra que s&#039;apliqui la llei esmentada de forma retroactiva a situacions consolidades derivades d&#039;acords comunitaris un\u00e0nimes com va ser el d&#039;exempci\u00f3 de les despeses d&#039;ascensor a la demandant i altres propietaris, cosa que no considerem possible, mitjan\u00e7ant la modificaci\u00f3 d&#039;un anterior acord que possibilitou. comunitat de ve\u00efns canvi\u00ef acords presos amb anterioritat, per\u00f2 sempre que no afectin situacions consolidades a favor d&#039;altres propietaris\u201d.<\/em><\/p>\n\n<p>La sent\u00e8ncia recorda, a m\u00e9s, quina \u00e9s la posici\u00f3 del Tribunal Suprem i del Tribunal Constitucional sobre la retroactivitat de les lleis, en especial, sobre situacions consolidades en el temps.<\/p>\n\n<h2 class=\"wp-block-heading\">Necessites assessorament?<\/h2>\n\n<p>A Afirma Serveis Jur\u00eddics i Mediaci\u00f3 som advocats i mediadors homologats per la Conselleria de Just\u00edcia de la Generalitat de Catalunya i pel\" Ministerio de Just\u00edcia d'Espa\u00f1a\".<\/p>\n\n<p>Contacta amb nosaltres i t&#039;assessorarem sense comprom\u00eds a la teva primera consulta.
