{"id":239,"date":"2022-10-29T11:04:00","date_gmt":"2022-10-29T09:04:00","guid":{"rendered":"http:\/\/afirma-juridico.local\/?p=239"},"modified":"2024-02-13T09:35:46","modified_gmt":"2024-02-13T08:35:46","slug":"okupacion-de-vivienda-y-empadronamiento-puede-el-propietario-de-una-vivienda-okupada-negarse-al-empadronamiento-del-okupa","status":"publish","type":"post","link":"https:\/\/afirmajuridico.com\/cat\/okupacion-de-vivienda-y-empadronamiento-puede-el-propietario-de-una-vivienda-okupada-negarse-al-empadronamiento-del-okupa\/","title":{"rendered":"Okupaci\u00f3 d&#039;habitatge i empadronament: el propietari d&#039;un habitatge okupat pot negar-se a l&#039;empadronament de l&#039;okupa?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Aquesta pol\u00e8mica q\u00fcesti\u00f3 est\u00e0 regulada al Reial Decret 1690\/1986, d&#039;11 de juliol, que aprova el Reglament de Poblaci\u00f3 i Demarcaci\u00f3 Territorial de les Entitats Locals.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta norma estableix que \u201ctota persona que visqui a Espanya est\u00e0 obligada a inscriure&#039;s al padr\u00f3 del municipi on resideixi habitualment\u201d (art. 54.1) i \u201cs\u00f3n ve\u00efns del municipi les persones que hi resideixen habitualment, en els termes establerts a l&#039;article 54.1 d&#039;aquest Reglament, es troben inscrits al padr\u00f3 municipal\u201d (art. 55.1). I, per aix\u00f2, &quot;El padr\u00f3 municipal \u00e9s el registre administratiu on consten els ve\u00efns d\u00b4un municipi&quot; (art. 53.1). A m\u00e9s, \u201cels Ajuntaments declararan d&#039;ofici la inscripci\u00f3 al seu padr\u00f3 com a ve\u00efns a les persones que visquin habitualment al seu terme municipal i no hi figurin inscrits\u201d (art. 73)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El que \u00e9s determinant \u00e9s, doncs, la resid\u00e8ncia al municipi i, a aquest efecte, per comprovar aquesta resid\u00e8ncia, \u201cl&#039;Ajuntament podr\u00e0 comprovar la veracitat de les dades consignades pels ve\u00efns, exigint a aquest efecte la presentaci\u00f3 del document nacional d&#039;identitat o targeta de resid\u00e8ncia, el llibre de fam\u00edlia, el t\u00edtol que legitimi l&#039;ocupaci\u00f3 de l&#039;habitatge o altres documents an\u00e0legs\u201d (art. 59.2).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Podria semblar que si l&#039;Ajuntament pot exigir \u201cel t\u00edtol que legitimi l&#039;ocupaci\u00f3 de l&#039;habitatge\u201d \u00e9s per concloure que si no hi ha tal t\u00edtol leg\u00edtim llavors es podria considerar que no hi ha tal resid\u00e8ncia.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No obstant aix\u00f2, aquesta conclusi\u00f3 \u00e9s nom\u00e9s un miratge: ni la definici\u00f3 de \u201cresid\u00e8ncia\u201d ni la interpretaci\u00f3 que fa la pr\u00f2pia administraci\u00f3, dels preceptes esmentats ajuden a sostenir aquesta conclusi\u00f3:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1) D&#039;una banda, segons el diccionari de la RAE, resid\u00e8ncia \u00e9s \u201cl&#039;acci\u00f3 i l&#039;efecte de residir\u201d, \u201clloc en qu\u00e8 es resideix\u201d o \u201ccasa en qu\u00e8 es viu\u201d, i residir \u00e9s \u201cestar establert en un lloc\u201d . Observeu que en cap cas no es condiciona que aquesta acci\u00f3 o establiment siguin legals.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2) D&#039;altra banda, la Resoluci\u00f3 de 17 de febrer del 2020, de la Presid\u00e8ncia de l&#039;Institut Nacional d&#039;Estad\u00edstica i de la Direcci\u00f3 General de Cooperaci\u00f3 Auton\u00f2mica i Local, per la qual es dicten instruccions t\u00e8cniques als Ajuntaments sobre la gesti\u00f3 del Padr\u00f3 municipal , estableix en norma 2 que \u201cl&#039;Ajuntament podr\u00e0 comprovar la veracitat de les dades consignades pels ve\u00efns, exigint a aquest efecte la presentaci\u00f3 dels documents que acreditin la seva identitat i el domicili al municipi, que es defineixen als apartats corresponents d&#039;aquesta Resoluci\u00f3 \u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I, m\u00e9s endavant, diu quin \u00e9s l&#039;objectiu del Padr\u00f3: \u201cdeixar const\u00e0ncia d&#039;un fet, i per aix\u00f2, en principi, no ha de resultar distorsionat ni pels drets que puguin o no correspondre al ve\u00ed per residir en aquest domicili\u201d i afegeix : \u201cI, en concret, la possibilitat que l&#039;Ajuntament sol\u00b7liciti del ve\u00ed \u201cel t\u00edtol que legitimi l&#039;ocupaci\u00f3 de l&#039;habitatge\u201d (article 59.2 del Reglament de Poblaci\u00f3 i Demarcaci\u00f3 Territorial de les Entitats Locals) no atribueix a les Administracions Locals cap compet\u00e8ncia per jutjar q\u00fcestions de propietat, d&#039;arrendaments urbans o, en general, de naturalesa juridicoprivada, sin\u00f3 que t\u00e9 per \u00fanica finalitat servir d&#039;element de prova per acreditar que, efectivament, el ve\u00ed habita al domicili que ha indicat\u201d \u2026 \u201cAix\u00ed mateix , el gestor municipal podr\u00e0 comprovar per altres mitjans (informe de Policia local, inspecci\u00f3 del propi servei, etc.) que realment el ve\u00ed habita en aquest domicili, i en cas afirmatiu inscriure&#039;l al Padr\u00f3\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En conclusi\u00f3, la resid\u00e8ncia \u00e9s un fet i se&#039;n deriva el dret a, i l&#039;obligaci\u00f3 de, empadronar, amb independ\u00e8ncia de la legitimitat d&#039;aquest fet, ia l&#039;Ajuntament li correspon constatar la seva realitat; per aix\u00f2 pot emprar diversos recursos, entre ells, i no nom\u00e9s, demanar el t\u00edtol habilitant per a l&#039;ocupaci\u00f3 per\u00f2, si aquest no existeix, no per aix\u00f2 es pot denegar la realitat de la resid\u00e8ncia i s&#039;ha de complir el deure d&#039;empadronar, fins i tot d&#039;ofici , sense necessitat que ho sol\u00b7licite l&#039;interessat.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Una altra cosa \u00e9s el debat que es pugui generar sobre l&#039;estatus jur\u00eddic d&#039;una persona que arriba a residir en un habitatge que ha okupat il\u00b7legalment, en una acci\u00f3 que pot arribar a ser delictiva i, per tant, antisocial, i hi accedeix, malgrat aix\u00f2, al Padr\u00f3 i, autom\u00e0ticament, la condici\u00f3 de \u201cve\u00ed\u201d amb tots els drets que aix\u00f2 comporta.
