{"id":247,"date":"2022-08-11T11:14:00","date_gmt":"2022-08-11T09:14:00","guid":{"rendered":"http:\/\/afirma-juridico.local\/?p=247"},"modified":"2024-02-13T09:36:59","modified_gmt":"2024-02-13T08:36:59","slug":"sucesiones-se-puede-desheredar-a-un-heredero-forzoso-por-falta-de-relacion-familiar","status":"publish","type":"post","link":"https:\/\/afirmajuridico.com\/cat\/sucesiones-se-puede-desheredar-a-un-heredero-forzoso-por-falta-de-relacion-familiar\/","title":{"rendered":"Successions.- Es pot desheretar un hereu for\u00e7\u00f3s per manca de relaci\u00f3 familiar?"},"content":{"rendered":"<p>Els hereus for\u00e7osos s\u00f3n aquelles persones a qui, per ra\u00f3 de parentiu, la llei els atribueix, obligat\u00f2riament, una part de l&#039;her\u00e8ncia, la lleg\u00edtima, llevat que hi hagi causa justa de desheretament i el causant (el que preveu la seva successi\u00f3 per despr\u00e9s de la seva mort) aix\u00ed ho faci valer en testament.&nbsp;<\/p>\n\n\n\n<p>A Catalunya s\u00f3n hereus for\u00e7osos els fills i, si no n&#039;hi ha, els descendents ia falta d&#039;aquests, amb algunes excepcions, els pares i, un dels motius pels quals se&#039;ls pot desheretar \u00e9s \u201cl&#039;abs\u00e8ncia manifesta i continuada de relaci\u00f3 familiar entre el causant i el legitimari, si \u00e9s per una causa exclusivament imputable al legitimari\u201d (article 451-17.2.e, del Codi civil de Catalunya).&nbsp;<\/p>\n\n\n\n<p>\u00c9s a dir, la resposta a la pregunta d&#039;aquest article \u00e9s que s\u00ed, es pot desheretar per manca de relaci\u00f3 familiar sempre que la causa que no existeixi aquesta relaci\u00f3 sigui imputable a l&#039;hereu for\u00e7\u00f3s i el causant aix\u00ed ho expresso en testament.&nbsp;<\/p>\n\n\n\n<p>&nbsp;No obstant aix\u00f2, el redactat de l&#039;article deixa oberts molts dubtes, com ara: durant quant de temps s&#039;ha de prolongar la manca de relaci\u00f3?;  qu\u00e8 passa si malgrat la manca de relaci\u00f3, en els darrers mesos l&#039;hereu for\u00e7\u00f3s vol restablir-la i \u00e9s el causant qui la rebutja?, o l&#039;abs\u00e8ncia de relaci\u00f3 ha de ser total o absoluta?, hi ha abs\u00e8ncia de relaci\u00f3 si per exemple, causant i hereu for\u00e7\u00f3s coincideixen en esdeveniments familiars i se saluden respectuosament? I si l&#039;abs\u00e8ncia de relaci\u00f3 ve donada per motius professionals, o de for\u00e7a major?&nbsp;<\/p>\n\n\n\n<p>Una altra cosa \u00e9s, a m\u00e9s, com \u00e9s de complicat ser atribuir a un de sol (en aquest cas, l&#039;hereu for\u00e7\u00f3s) la causa de la manca de relaci\u00f3 ja que, en moltes ocasions, les causes que dues persones no es relacionin seran imputables, en major o menor mesura, a totes dues.&nbsp;<\/p>\n\n\n\n<p>Com es pot apreciar, aquest tema pot ser, i \u00e9s, font de litigis entre l&#039;hereu for\u00e7\u00f3s que s&#039;ha vist desheretat (moltes vegades sorprenentment, quan obt\u00e9 c\u00f2pia del testament, despr\u00e9s de la mort del causant) i els altres beneficiaris de l&#039;her\u00e8ncia.&nbsp;<\/p>\n\n\n\n<p>Seguint els consells de l&#039;Audi\u00e8ncia Provincial de Barcelona, secci\u00f3 14, a la seva sent\u00e8ncia de 13\/02\/2014, quan el testador estableixi la causa de desheretament en testament, no s&#039;hauria de limitar a dir quina \u00e9s aquesta causa sin\u00f3 que, per refor\u00e7ar la seva voluntat i, alhora que el notari pugui detectar o descartar possibles situacions injustes per a l&#039;hereu for\u00e7\u00f3s, hauria d&#039;explicar les raons per les quals considera que hi concorre la causa de desheretament.<\/p>","protected":false},"excerpt":{"rendered":"<p>Desheretar per manca de relaci\u00f3 familiar: Qu\u00e8 diu la llei?
