Prefer\u00e8ncia per al cobrament de les quantitats degudes pels propietaris."},"content":{"rendered":"<p class=\"wp-block-paragraph\">La morositat que pateixen les comunitats de propietaris constitueix una greu problem\u00e0tica que impedeix una gesti\u00f3 efica\u00e7 de l&#039;edifici i un sacrifici per als propietaris que s\u00f3n diligents en el compliment de les seves obligacions i que es veuen abocats a finan\u00e7ar la part de despeses de la comunitat que no fan els seus ve\u00efns morosos.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Una de les mesures m\u00e9s eficaces per pal\u00b7liar en moltes ocasions aquesta problem\u00e0tica \u00e9s la prefer\u00e8ncia per al cobrament, que permet a la comunitat de propietaris reclamar les quotes impagades com a creditor preferent per la qual cosa, de conc\u00f3rrer amb altres deutes contrets pel propietari aquells podran ser reclamades, i conseq\u00fcentment cobrades, de forma priorit\u00e0ria, fins i tot abans de la hipoteca que hi hagi sobre el pis o local del propietari mor\u00f3s.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta prefer\u00e8ncia, per\u00f2, s&#039;ha d&#039;exercir en un procediment judicial de &#039;terceria de millor dret&#039; dins del procediment d&#039;execuci\u00f3 que hagi instat un altre creditor (per exemple, dins del procediment d&#039;execuci\u00f3 hipotec\u00e0ria).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per\u00f2 cal tenir en compte que aquest privilegi estar\u00e0 subjecte a l&#039;estricta observan\u00e7a del l\u00edmit temporal fixat per la mateixa llei, que consisteix en la possibilitat de reclamar amb car\u00e0cter preferent nom\u00e9s la quota imputable a la part ven\u00e7uda de l&#039;anualitat en curs i la de els tres anys anteriors (quatre a Catalunya).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Tribunal Suprem, en la sent\u00e8ncia 363\/2022, de 4 de maig, considera que el moment inicial del per\u00edode de prefer\u00e8ncia \u00e9s el de la data de reclamaci\u00f3 judicial de la comunitat en qu\u00e8 sol\u00b7licita la prefer\u00e8ncia.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>Com gestionar la morositat de manera efica\u00e7 i priorit\u00e0ria segons el Tribunal Suprem.
