Comunitat de Propietaris. - El propietari dels baixos de l&#039;edifici ha de sufragar les despeses d&#039;instal\u00b7laci\u00f3 de l&#039;ascensor que no utilitza? i els de manteniment i conservaci\u00f3?"},"content":{"rendered":"<p>El Tribunal Suprem a la seva sent\u00e8ncia de 10 de maig de 2021 ha confirmat la seva jurisprud\u00e8ncia i, sobre la base dels articles 9.1e) i 10.1 de la Llei de Propietat Horitzontal, respon negativament a la primera q\u00fcesti\u00f3 i negativament a segona. El Tribunal reitera que la instal\u00b7laci\u00f3 de l&#039;ascensor o l&#039;ampliaci\u00f3 de la seva traject\u00f2ria, \u00aba cota zero\u00bb, \u00e9s necess\u00e0ria per a l&#039;habitabilitat i l&#039;\u00fas total de l&#039;immoble, imposada per la normalitzaci\u00f3 del gaudi per tots els ve\u00efns, i no com una simple obra innovadora de millora i per tant tots els propietaris han de contribuir a les despeses de la seva instal\u00b7laci\u00f3. A Catalunya, que disposa de regulaci\u00f3 pr\u00f2pia, l&#039;article 553-30 del Codi civil distingeix segons el tipus d&#039;instal\u00b7laci\u00f3: a) Si \u00e9s una instal\u00b7laci\u00f3 no exigible segons la llei, els propietaris que s&#039;hi oposin no estan obligats a contribuir al pagament dels despeses si aquestes superen la quarta part del pressupost anual, per\u00f2 si superen aquest import, s\u00ed que tindran obligaci\u00f3 de contribuir. b) Si \u00e9s una instal\u00b7laci\u00f3 necess\u00e0ria per garantir l&#039;accessibilitat i l&#039;habitabilitat de l&#039;edifici, com ara la supressi\u00f3 de barreres arquitect\u00f2niques o instal\u00b7laci\u00f3 d&#039;ascensors, tots han de contribuir a les despeses d&#039;instal\u00b7laci\u00f3.
