El Promotor, en compliment del que disposa la llei 57\/1968, de 27 de juliol, sobre percepci\u00f3 de quantitats anticipades en la construcci\u00f3 i venda d&#039;habitatges va lliurar un aval bancari a favor del comprador en garantia de la devoluci\u00f3 de les quantitats lliurades a compte per al cas que el promotor no lliur\u00e9s en termini.&nbsp;<\/p>\n\n\n\n<p>El promotor va oferir el lliurament de l&#039;habitatge al comprador i aquest li va exigir que aixequ\u00e9s les hipoteques, cosa que el promotor no va fer, motiu pel qual finalment el comprador va exigir la resoluci\u00f3 del contracte i la devoluci\u00f3 de les quantitats lliurades (30.000\u20ac). El promotor no va atendre el requeriment i el comprador va demandar el promotor i el banc avalador.&nbsp;<\/p>\n\n\n\n<p>El Jutjat de 1a Inst\u00e0ncia va donar la ra\u00f3 al comprador per\u00f2 l&#039;Audi\u00e8ncia Provincial va revocar la sent\u00e8ncia en considerar que la Llei 57\/1968 nom\u00e9s exigeix al banc avalador el pagament de les quantitats avalades en el cas que transcorri el termini de lliurament de l&#039;habitatge, sent irrellevant per al banc qualsevol altre tipus d&#039;incompliment. &nbsp;<\/p>\n\n\n\n<p>El Tribunal Suprem en la sent\u00e8ncia de 8\/3\/21 reitera la jurisprud\u00e8ncia sobre aquesta mat\u00e8ria en el sentit que l&#039;obligaci\u00f3 de lliurar l&#039;habitatge en termini, garantit per l&#039;aval, s&#039;ha d&#039;entendre en el sentit de lliurament efectiu, per la qual cosa si l&#039;aval garanteix la devoluci\u00f3 de les bestretes del comprador en cas de manca d&#039;acabament de l&#039;edificaci\u00f3 dins el termini pactat, amb m\u00e9s ra\u00f3 l&#039;haur\u00e0 de garantir quan el venedor supediti l&#039;atorgament d&#039;escriptura p\u00fablica al pagament d&#039;un preu m\u00e9s gran que l&#039;estipulat o pretengui lliurar l&#039;habitatge amb c\u00e0rregues hipotec\u00e0ries quan es va pactar lliure de c\u00e0rregues\u00bb, que va ser el que va passar en aquest cas. Per tant i com aleshores, tamb\u00e9 en aquest cas el comprador tenia \u00abpoderoses i evidents\u00bb raons per actuar com ho va fer (instant la resoluci\u00f3 del contracte per incompliment de la promotora anterior que aquesta li requer\u00eds per escripturar) ja que la promotora no va atendre el requeriment del comprador perqu\u00e8 proced\u00eds a cancel\u00b7lar les hipoteques abans de l&#039;atorgament de l&#039;escriptura.&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Tribunal Suprem: Garantia del banc avalador en compravenda d&#039;habitatge en construcci\u00f3.
