Aquest instrument jur\u00eddic permet que, si es donen una s\u00e8rie de requisits que s&#039;han fixat per la jurisprud\u00e8ncia, es pugui revisar un negoci jur\u00eddic que ha patit un fet imprevisible posterior a la celebraci\u00f3 del contracte. El que pret\u00e9n \u00e9s solucionar els problemes derivats d\u201funa alteraci\u00f3 sobrevinguda i imprevisble de la situaci\u00f3 inicial i evitar que es trenca l\u201fequilibri de prestacions.&nbsp;<\/p>\n\n\n\n<p>\u00c9s destacable que al contracte d&#039;arrendament d&#039;ind\u00fastria la renda pactada s&#039;establia en funci\u00f3 de la facturaci\u00f3, amb un m\u00ednim. El tribunal considera que, malgrat aix\u00f2, pot ser aplicada la teoria de la &#039;cl\u00e0usula rebus&#039; ja que no implica que s&#039;hagu\u00e9s previst una situaci\u00f3 com la descrita ni que la seva finalitat fos pal\u00b7liar els efectes d&#039;una pand\u00e8mia per ning\u00fa imaginable, ni que aix\u00f2 suposi que el demandat degui ja per aquest simple fet assumir qualsevol risc de la classe que fos, fins i tot el m\u00e9s greu, extrem o catastr\u00f2fic, sobretot quan la renda es va fixar en funci\u00f3 d&#039;un percentatge de la facturaci\u00f3 \u00abprevisible\u00bb, i quan la pand\u00e8mia no era a l&#039;horitz\u00f3 i per tant no era un risc imaginable ni molt menys va ser assumit per les parts.<\/p>","protected":false},"excerpt":{"rendered":"<p>Audi\u00e8ncia Provincial de Val\u00e8ncia reconeix ajornament del 50% del lloguer a hotel per COVID-19.
